A driver tried to blame his DUI on his dinner.

75-year-old John Przybyla was pulled over in Adams County, Wisconsin.

A police officer says he smelled alcohol, but Przybyla said he had not been drinking.

He then blamed the smell on beer-battered fish.

But then he failed some field sobriety tests.

A breath test showed his blood alcohol level was just below the normal legal limit.

But since this was Przybyla’s 10th offense, the limit is lower and he was arrested.
