Mother sues CPS, claims 5-year-old son sexually abused by students

CHICAGO — An attorney and advocate for survivors of sexual abuse has filed a lawsuit against Chicago Public Schools and the Board of Education for the sexual abuse of a kindergarten student.

The incidents are alleged to have occurred at Wendell Smith Elementary School on the city’s South Side during the 2013-2014 school year.

According to the suit, the 5-year-old boy was forced to engage in sexual acts against his will with at least two other students on 3 occasions.

More than one incident is alleged to have occurred after a report to the school principal from a school employee.

The incidents occurred while the boys were using a bathroom intended for older children, without supervision.

Despite the notice, the principal and teacher continued to allow the boys to use the bathroom together, unsupervised, and the incidents continued.  At least one incident was later reported to DCFS by a school employee, and is believed to have involved several more students.
