Man charged with murder after reported sexual assault in Burnside

CHICAGO — A man was killed while trying to protect his niece who reported being sexually assaulted Thursday in the Burnside neighborhood.

The incident took place in the 500 block of East 89th Place around 9 p.m. 

On Saturday, police arrested Kenneth Malone, 25, for first degree murder.

Police said Friday afternoon they have found inconsistencies in the initial story.

Earlier police said a man climbed into a window and sexually assaulted a 17-year-old girl in a bedroom. After hearing her screaming, her uncle, 66 year old James Lewis rushed in. Malone shot Lewis in the head and back, according to police.

Officers responding to the scene quickly took him into custody.

Police later said Malone was invited to the house by the girl and pointed out Sunday that he was not charged with sexual assault.

Lewis was pronounced dead at the University of Chicago Medical Center. His niece was being treated at Trinity Hospital. 

Initial reports by police said the Malone climbed into the home through a window.

Malone is scheduled to appear in bond court Sunday.
