An Indiana woman told FOX59 in Indianapolis, Ind. she was fired from her job after she asked her bosses for a place at work to pump her breast milk.
According to the report, the woman, Erika Zinn, recently got a seasonal job at Rural King, a farm and home store in Shelbyville, Ind. She told the station she mentioned breastfeeding to her employer right away.
"I brought that up immediately in my orientation explaining that…if I work over four hours, I need to pump,” Zinn told the station. “I need to have milk at home for her. She won’t take formula," Zinn added, referencing her daughter.
The woman told FOX59 a manager told her to use the bathroom during her break, but Zinn said she refused, saying she wanted a cleaner environment.
After a co-worker said she could use a fitting room, Zinn did just that. But she was again asked to use the restroom, and then she was fired, according to the woman.
Her manager "said that due to my availability not being completely open and my needs, all the issues that arose due to my needs, that I wasn’t a good suit for the job,” Zinn told the station.
FOX59 notes that according to Indiana Law Code, “an employer shall provide a private location, other than a toilet stall, where an employee can express the employee’s breast milk in privacy during any period away from the employee’s assigned duties.”
The woman filed a complaint with the Illinois Department of Labor, but even if Zinn was wrongfully terminated, the agency does not have jurisdiction in the case, an IDOL spokesman told the station.
“I was doing a good job at work, but simply because I wanted to do the best for my daughter I lost my job," Zinn told the station. "That’s not right.”
