A sperm bank malfunction is at the center of a lawsuit filed against Northwestern Memorial Hospital.

40 lawsuits were filed on behalf of men whose illnesses or treatments could cause infertility.

Some of their samples were destroyed in April of last year, when a tank failed to keep them frozen.

The man claim Northwestern failed to respond when it knew the system failed.

They also question storing all the samples in one tank, when other tanks were available.

Northwestern officials say they “deeply regret” the equipment malfunction, but, that in many cases, samples may still work for in vitro fertilization.
