A couple inured by a water tower that fell off of a Lakeview apartment building on Wednesday has filed a lawsuit against the building’s condominium association.

Jack Baginski, 29, was helping his girlfriend Lauren Hussar, 27, move from the apartment, located at 2800 N. Pine Grove Avenue, when the water tower came crashing down. Baginski and Hussar were rushed to Advocate Illinois Masonic Medical Center; Baginski has been released, but Hussar is still in the hospital.

“We are immediately seeking all maintenance and inspection records for this building and its water tank,” said Richard F. Burke, Jr., a partner at Clifford Law Offices, the law office handling the lawsuit.  “People living in densely populated neighborhoods need to know these aging water tanks are safe.”

An unspecified amount of damages are being sought in the lawsuit, which has been filed through Cook County Circuit Court.
