Michael Jordan and Dominick’s Finer Foods will go to trial over a magazine ad with Jordan’s picture on it.

Jordan said the supermarket chain and its parent firm Safeway didn’t get permission to use his name in a Sports Illustrated ad when Jordan was inducted into the basketball Hall of Fame.

Jordan wants $5 million in damages; Federal judge Milton Shadur said that’s too much, and he called the lawsuit “greedy.”

Jordan slipped into the Dirksen Federal Building through the underground parking garage Wednesday to attend a settlement conference; but despite a scolding by the judge, Jordan refused to settle.
