CHICAGO —  Chicago Fire Dept officials are now admitting that a former top official was driving under the influence of alcohol in a crash earlier this week.

John McNicholas resigned from his job as deputy commissioner yesterday.

Early yesterday morning, he was driving a city vehicle when he hit a light pole on LaSalle Street, just off Lake Shore Drive.

The fire department says he was operating that vehicle in violation of department policy.

In a statement tonight, the department says a breathalyzer test shows McNicholas was under the influence at the time of the crash.

He was cited for negligent driving, not DUI.

The crash is still under investigation.
